PURCHASING TERMS AND CONDITIONS FROM SELLER (GLOBAL OUTDOOR CONCEPTS, INC. “MirageVision”) TO THE PURCHASER

Miragevision Website Purchase Terms & Warranty 2026-0301

The Terms and Conditions of the sales of the product(s) are limited to those stated herein. Any additional, different, conditioned, verbal, or express in any form must be stated in writing and attached to and/or included in the Seller’s Invoice. The Customer/Purchaser agrees to be bound by these Sales Terms and Conditions with the acceptance of the Sales Invoice and the acceptance of the delivered invoiced product(s).

These Terms and Conditions shall constitute a legal binding contract between the Customer/Purchaser and the Seller. The Customer/Purchaser accepts these Terms and Conditions set forth within by making a purchase from and/or placing an order with the Seller via Phone Sale, Website Sale, Website E-Commerce Sale, Mobile Site Application, and/or Seller’s Authorized Independent Reseller. These Terms and Conditions are subject to change without prior notice, except the Terms and Conditions posted on the Sellers Main Website at the time the Customer/Purchaser places the sales order or accepts the Product Sales Invoice.

The stated Terms and Conditions stated here within shall contain the entire understanding between the Customer/Purchaser and the Sales Company (Global Outdoor Concepts, Inc./GOC) and shall supersede and replace in its entirety any and all prior communications and contemporaneous agreements and/or understanding, whether oral, written, electronic and/or implied with respect to the submitted Sales Invoice of the Sales Company’s Products. The Customer/Purchaser shall be bound to these terms and conditions, as well as the terms and conditions stated on the submitted Sales Invoice, once the Sales Invoice has been submitted to the Customer/Purchaser via Email, US Postal Mail and/or Fax and Payment is made.

THE GOVERNING LAW
These Terms and Conditions, Statement of Work, Sale Invoice and/or Sale of Products will be governed by the laws of the State of Nevada, without regard to conflicts of law rules, any arbitration, enforcement of any arbitration or court of law litigation will be brought exclusively in Clark County, Nevada. Both the Customer/Purchaser and the Sale Company agree that the final Sales and Venue of this Sales Invoice Contract shall be considered in Clark County, Nevada. Neither Party shall institute any action in any form arising out of these Terms and Conditions of this Sales Transaction (other than an action for the Customer/Purchaser’s lack of nonpayment owed to the Seller) for more than a one (1) year period after the cause of action has materialized.

SHIPPING OUTSIDE OF THE CONTINENTAL UNITED STATES
All shipments outside of the Continental United States do NOT qualify for any free shipping discounts, furthermore all shipments outside the Continental United States, such as but not limited to Hawaii, Alaska, Puerto Rico, Mexico or Canada shall require an individual shipping quote for each order.

RISK OF SHIPPING DAMAGES AND/OR LOSS
All shipments, title and ownership to the Products and risk of loss or damage during shipment shall pass from the Seller to the Customer/Purchaser from Sellers shipping location (F.O.B.) Las Vegas, Nevada, (freight and shipping insurance prepaid and added). Once the Product Invoice has been submitted and payment has been received and the shipping Bill of Lading has been issued the ordered Product becomes the property of the Customer/Purchaser, although the Seller shall assist (at their own discretion) the Customer/Purchaser with any shipping claims and /or replacements if lost or total loss due to shipping damages, but at no time shall Seller be responsible for product replacement due to third party shipping damages or lost goods. Customer/Purchaser must inspect the package for any visible damage to the packaging before signing off on any shipping documents. If any visible box damage, such as but not limited to; holes, box wrinkles, crush marks, scrape marks and etc. Customer/Purchaser must report it to the driver and before signing for the packaging and make sure the driver writes on the shipping docs, “box damage.” Failure to do this will void the shipping insurance. Customer/Purchaser must inspect the contents of the box, including the powering up the TV and all accessories within 48 hours of delivery and report any contents damage to our office immediately at 702 533 8899.

PAYMENT OF THE ORDER
Orders are not considered binding until accepted by the Seller. Customer/Purchaser agrees to pay in full the total invoiced purchase price for the ordered Products plus shipping charges and shipping insurance, including any shipping charges that are billed back to the Seller as a result of using their Customer/Purchaser’s shipping account number. Terms of payment are at the sole discretion of the Seller. All invoices are due and payable within the time frame specified on the Seller’s Invoice. Customer/Purchaser shall pay for, and will indemnify and hold Seller and its Affiliates harmless from any applicable sales, use, excise or any similar taxes and/or any federal, state, and/or local fees, taxes or charges imposed on, or otherwise associated with the Sales Order Invoice. Customer/Purchaser must claim any exemptions from any taxes, fees (local, state or federal) at the time of the purchase and further agrees to provide the Seller with necessary supporting documents. In the event of any Payment Default by the Customer/Purchaser, the Customer/Purchaser will be responsible for all Seller’s cost of collection, including but not limited to attorneys’ fees, court cost, filing fees, and/or collection agency fees. If in fact, payments are in default, the Seller reserves the right to suspend any further Services to the Customer/Purchaser, until such time the payment is received.

TAXES
All Sales outside of Nevada are exclusive of all sales, use, excise taxes and any simular taxes, duties and charges of any kind that are imposed by any state and/or federal governmental authority. Any such taxes, duties and charges shall be owed and paid by the Customer/Purchaser.

RETURN POLICY

5 Day Satisfaction Guarantee Policy: Customer/Purchaser can return any ordered product/ equipment within a 5 day time period from the date of delivery (excluding volume orders, special or custom product orders and discounted products/equipment, which will be stated on the Seller’s Invoice).

If the returned product/equipment is returned in its original packaging and the product has not been installed and the package and its content has not been damaged due to shipping and/or Customer/Purchaser handling, a refund will be issued to the Customer/Purchaser, minus any shipping charges, credit card charges (that have occurred with the customer's order) and/or if applicable, any applicable collected sales tax. If in fact, the product has been installed, this 5 Day Satisfaction Guarantee Policy will be Null and Void.

The Customer/Purchaser is totally responsible for the return shipping charges and further agrees to insure the return product/equipment for the original invoiced amount of the product/equipment. The returned product/equipment is subject to the Seller’s inspection and Seller shall have the sole discretion to determine if the returned packaging has not been used, damaged and/or installed.

In order for any return to be initiated, the Customer/Purchaser must first notify the Seller and receive the Seller’s RMA #, which includes the return instructions. Failure to return the product/equipment without the RMA #, will be subject to the Seller rejecting/refusing the returned product/equipment.

30 Day Return Policy: Customer/Purchaser can return any ordered product/equipment within a 30 day time period from the date of purchase (excluding volume orders,, special or custom or discounted product/equipment). The returned product/equipment must be returned undamaged, in its original shipped condition and in its original shipping cartons.

If the returned product/equipment is returned undamaged, in its original shipped condition and in its original shipping cartons and the package and its content has not been damaged due to any shipping damage, a refund will be issued to the Customer/Purchaser, minus a minimum 20% restocking fee will be subtracted from the original product invoiced price (due to the product is now considered used), minus any shipping charges (that have occurred with customer's order) and/or if applicable, minus any applicable collected sales tax. The Customer/Purchaser is totally responsible for the return shipping charges and further agrees to insure the return product/equipment for the original invoiced amount of the product/equipment. The returned product/equipment is subject to the Seller’s inspection and Seller shall have the sole discretion to determine if the returned product/equipment has not been damaged, has been returned in its original shipped condition and all the original parts and equipment has been returned.

In order for any return to be initiated, the Customer/Purchaser must first notify the Seller and receive and approve the Seller’s RMA #, which includes the return instructions. Failure to return the product/equipment without the RMA #, will be subject to the Seller rejecting/refusing the returned product/equipment.

PRODUCT WARRANTY

Platinum & Gold Series (Residential & Commercial Non-24/7 Use)

One (1) Year Parts and In-Factory Labor Limited Warranty with an option to purchase an extended 2nd or 2nd & 3rd Year limited White Glove Extended Warranty (excludes used, demo, close-out and/or discounted products which will be warranted on a case-by-case order basis). Note: if the TV is being used for 24/7 use, Extended Warranties are not available. Note: if the TV is replaced under the 1 Year Limited Warranty term, the Replacement TV warranty does not start all over again, but will be warranted according to the Original TV Warranty date or the date noted on the Replacement TV invoice, whichever is longer. Note: if in fact the TV Panel is defective under the 1 Year Warranty, the TV will not be repaired and a replacement TV will be offered. If in fact, the exact original invoiced size and model is not available or is discontinued by the Seller, Customer/Purchaser agrees to accept a similar size and comparable model. A copy of this Warranty and the Operations/Owner Manual will be included in product packaging and the Customer/Purchaser is responsible for registering the Warranty with the Seller via certified mail or online at www.miragevision.com. Failure to register the 1 Year Limited Warranty within 45 days from delivery will void the 1 Year Warranty. Failure to abide by the written details in the Operator/Owner Manual and the written 1 Year can void your warranty. A copy of this warranty is provided by the Seller within the product shipping carton, on the customer invoice and on our website at www.miragevisiontv.com.

Silver, Emerald, Ruby & Diamond (Residential Use Only)

One (1) Year Parts and In-Factory Labor Limited Warranty with an option to purchase an extended 2nd or 2nd & 3rd Year limited White Glove Extended Warranty (excludes used, demo, close-out and/or discounted products which will be warranted on a case-by-case order basis) Note: if in fact the TV Panel is defective under the written warranty, the TV will not be repaired and a replacement TV will be offered. If in fact, the exact original invoiced size and model is not available or is discontinued by the Seller, Customer/Purchaser agrees to accept a similar size and comparable model. Note: if the TV is replaced under the 1 year warranty term, the replacement TV warranty does not start all over again, but will be warranted according to the Replacement TV Invoice. A copy of the Warranty and the Operations/Owner Manual will be included in product packaging and the Customer/Purchaser is responsible for registering the Warranty with the Seller via certified mail or on our website at www.miragevisiontv.com. Failure to register the warranty within 45 days from delivery will void the warranty. Failure to abide by the written details in the “Operator/Owner Manual and/or Written Limited Warranty provided by the Seller that is located within the product/equipment shipping box can void your product/equipment.

Displays for Commercial & Residential 24/7 Use

One (1) Year Parts and In-Factory Labor Limited Warranty with an option to purchase an extended 2nd or 2nd & 3rd year limited White Glove Extended Warranty (excludes used, demo, close-out and/or discounted products which will be warranted on a case-by-case order basis). Note: if the display is replaced under the 1 Year Factory Warranty term, the Replacement TV warranty does NOT start all over again, but will be warranted according to the Original TV order date or based on the Replacement TV invoice notes, whichever date later. NOTE: if in fact the TV Panel is defective under the Factory Limited Warranty, the TV will not be repaired and a replacement TV will be offered. If in fact, the exact original invoiced size or model is not available or is discontinued by the Seller, Customer/Purchaser agrees to accept a similar size and comparable donor model. A copy of this Warranty and the Operations/Owner Manual will be included in the product packaging and the Customer/Purchaser is responsible for registering the Warranty with the Seller via certified mail or on our website at www.miragevision.com. Failure to register the product warranty within 45 days from delivery will void the Warranty. Failure to abide by the written details in the “Operator/Owner Manual and/or Written Limited Warranty provided by the Seller that is located within the product/equipment shipping box can void your product.

NOTE: The First Year, all MirageVision TVs will carry a one (1) Parts and In-Factory Labor Limited Warranty from Global Outdoor Concepts. Defective units covered by the product warranty must be issued a RMA and returned to Global Outdoor Concepts authorized service facility.

NOTE: An Optional 2 or 2 & 3 Year Extended Warranty is available to purchase through our designated independent third party extended warranty provider. Please call 702 533 8899 for further details, and pricing is available on each website product page.

NOTE: Any warranty repairs by our company will carry a 90 Day Warranty on the repair work only.

NOTE: All used, demo, close-out and/or discounted products/equipment will be warranted on a case-by-case ordered basis and will be stated on the Seller’s Invoice.

NOTE: At the time you have received the shipment of your Product, you must inspect your unit immediately after receiving and immediately report any shipping damages to our company…if not, any damages or defects will not be honored under this Warranty.

Outdoor TV Lift Cabinets

The MirageVision Premium & Custom Families of Outdoor Lift Cabinets are specifically engineered and manufactured for exterior environments, utilizing a high-quality poly ACM aluminum construction. These units feature a five-year limited warranty on the lift mechanism, alongside a five-year warranty covering the workmanship of the cabinet. This warranty is contingent upon proper use according to product specifications; damage resulting from abuse or environmental acts of nature will not be covered by this Warranty, see details below.

MirageVision will send customer replacement for defective parts.

Customer is responsible for local labor cost for the replacement. This is in lieu of Customer shipping the entire TV Lift Cabinet back to GOC’s Service Location.

Conditions of MirageVision TV Lift Cabinet Limited Warranty: The MirageVision Outdoor TV Lift Cabinet is warranted to be free of defects and workmanship from the time of purchase by the original owner. If this product is found and proved to be defective under the terms and conditions of this warranty, MirageVision will replace the defective part(s) and/or Components (Cabinet and Internal Lift) with a new and/or reconditioned Parts and Labor at no charge to the original owner, subject to the terms and conditions of this Limited Warranty. This Limited Warranty covers failures due to defects in material or workmanship that occurs during normal residential under normal outdoor wear and tear usage as follows:

  • Original Owner must provide verification of the date of purchase when requesting Limited Warranty Service. A copy of the original Dated Sales Receipt is required together with the product to obtain service under this Limited Warranty.
  • Any repairs or replacements must be performed by a MirageVision Authorized Service Facility or local designated MirageVision Service Representative.
  • Customer is responsible for returning (including any freight or shipping cost) the entire TV Lift Cabinet as it was originally received, back to a MirageVision Authorized Service Facility, before any replacement or repair is issued.

THIS LIMITED WARRANTY DOES NOT COVER THE FOLLOWING:

  • Shipping damage (Shipping Damage must be inspected within 24hrs of delivery and we must be notified).
  • Damage caused during customer unpacking, or removal of packing material and/installation.
  • Damage due to improper, incorrect or insufficient voltage. Must be installed using an Outdoor GFI 110v Outlet.
  • Damage due to power surges or lightning strike.
  • Damage which results from fire, flood, lightning, tornado, hurricane, large hail, extreme high winds, sand storms, vandalism, terrorism or other acts of God or Nature.
  • Any unit which has been modified, or damaged due to improper installation or failure to obey the operating instructions provided in the MirageVision Operators Instruction Manual.
  • Any failure, loss, damage or personal injury due to accident, neglect, misuse, abuse, improper operation, improper maintenance, improper storage, improper installation, alteration to the unit, or failure by the consumer to obey the operating instructions provided in the Operators Instruction Manuals.
  • Any owner/purchaser other than the original Invoiced Purchaser.
  • Any unit purchased from an unauthorized seller/dealer.
  • If the original product serial number or warning labels has been removed, defaced, or tampered with in any way.
  • Any transportation charges incurred in the connection with warranty service.
  • Indirect, consequential, or special damages, except as required by federal or state laws.
  • Any unit tampered with, modified, adjusted, or repaired by any party other than those authorized by MirageVision.
  • Any cosmetic damages to the cabinet surface, viewing screen or TV exterior that has been defaced, faded or stained and/or caused by normal wear and tear or exposure to chemicals, calcium or salt water spots, acid rain, bird droppings, large hail or adverse weather conditions. Because the TV cabinet and components are hand assembled and altered, we do not cover minor cabinet blemishes or minor scratches to the cabinet’s exterior.
  • Constant water from mister systems, lawn sprinklers, water falls, and etc. spraying on to or in the cabinet.
  • TV picture quality when installed with “direct sun” pointing towards or directly onto the front LCD screen.
  • Vibration damage and/or any damage due to installation and/or moving the cabinet around the yard.
  • Due to the fact, the Cabinet is custom hand assembled, we cannot guaranty minor cosmetic scratches and/or blemishes to the cabinet, cabinet outer skins and/or the cabinet top.
  • Tipping over the cabinet when left in the “up” position without properly secured and/or anchored to the ground or a secure structure.
  • Rain water entering the cabinet when left open in any down pouring rain or snow. NOTE: the cabinet must be closed during rain, snow or wind storms. Cabinet must also be closed when the TV is not in use.
  • Standing rain or water from flooding that is over the caster wheels or bottom, coming in contact with the cabinet material.
  • Warping of the top lid, due to closing/shutting it down and the lid comes in contact with a foreign object.
  • Normal fading of the outer cabinet material (it is normal for any outdoor material to fade a little).
  • Any abnormal installation such as, but not limited to underground and/or unlevel installation.
  • Labor Cost for replacement of any warranted Parts. Customer is responsible for any labor required to replace warranted replacement parts.

MirageVision and its representatives or agents shall in no event be liable for any general, indirect or consequential damages arising out of/or caused by the use of/or the inability to use this product. This warranty is made in lieu of all other warranties, expressed or implied, and all other liabilities on the part of MirageVision. All other warranties, including the warranties of merchantability and fitness for a particular purpose, are hereby disclaimed by MirageVision and its representatives and/or agents. The finale sale of this Product is made in the State of Nevada and is considered to have jurisdiction and legal venue in the State of Nevada.

All warranty inspections, repairs or replacements must be performed by MirageVision or its authorized service representative.

If MirageVision decides that the unit cannot be repaired ON-SITE, the entire unit must be returned to MirageVision’s designated repair facility and the customer is responsible for any of the packaging and return shipping cost. MirageVision will be responsible for the packaging and return shipping cost, once the repairs or replacement has been consummated.

If the customer chooses the Parts Only Warranty, MirageVision will ship the replacement defective parts directly to the Customer at no charge. Customer then is responsible for any labor cost related to the replacement parts. Customer is responsible for the return shipping cost related to the defective parts (if applicable).

Customer must notify MirageVision immediately upon the first sign of a problem or the warranty could be invalid.

WARRANTY PROCEDURES:

  • Contact us by phone @ (702) 533-8899 or online www.MirageVisionTV.com to troubleshoot and/or initiate a warranty claim.
  • You must return the entire product in proper packaging and insure the return shipment or accept the risk if the product is lost or damaged in shipping.
  • Please call us for our return shipping address and RMA #.
  • We will replace defective products with new or reconditioned parts, as stated in the Limited Warranty and return to you (freight free within the United States) via UPS or FedEx service or common over the road truck lines.
  • If in fact, we have determined that the original part is not defective or is not covered under this Limited Warranty, we will notify you and inform you of service alternatives that would be on a fee basis.

Under the 5-year parts and labor Limited Warranty, we must receive the entire TV Lift Cabinet Product back, before any replacement or repair will be issued.

NOTE: At the time you have received the shipment of your Product, you must inspect your unit immediately after receiving and immediately report any shipping damages to our company…if not, any damages or defects will not be honored under this Warranty.

Warranties On All Other Accessories: Shall be considered one (1) year parts and labor.

RETURNING THE PRODUCT FOR WARRANTY:

  • At the first sign of a warranty related problem, Customer/Purchaser must notify (via phone ) to the Seller. The Seller's Customer Service Department will answer and try to trouble-shoot or rectify the problem/issue over the phone and/or email. If in fact, the problem/issue cannot be resolved, the Customer Service Representative will request that the Customer/Purchaser fill out the “Warranty Request Form” that is displayed on the Seller’s Website. The defective product/equipment must be returned for repair or replacement and the Seller will issue the Customer a Return Merchandise Authorization (RMA) with return instructions.
  • Sellers must receive the defective product back to its designated service location, before any warranty repair or replacement will be issued. Failure to submit and/or providing a copy of the original Product Invoice the product/equipment warranty could be void.
  • Seller could request that the Customer/Purchaser send legible photos and/or video of the defect and/or photos and/or video of the installation location and wiring.
  • It is the Customer/Purchaser’s responsibility to return the defective product without any further defects and/or damages to the product, other than those detailed and stated in the written explanation. Any other defects and/or damages to the product once received by Customer/Purchaser should acquire adequate shipping insurance for the cost of the TV/Product in case of return shipping damages and/or loss of TV/product. Seller will void the warranty claim and will make the Customer/Purchaser responsible for those damages; such as, but not limited to; return shipping damage, cracked LCD screen, and/or damages to the outer cabinet.
  • It is the Customer/Purchaser’s responsibility to return the product in its original or equivalent packaging to prevent return shipping damages to the product.
  • It is the Customer/Purchaser’s responsibility to pay for the return shipping and shipping insurance charges. The Seller agrees to refund the return shipping and shipping insurance charges to the Customer/Purchaser (only) if the warranty claim is valid and the defect has occurred within a 60 day period from the original delivered product date. After the 60 day time period has expired, it is the Customer/Purchaser’s responsibility to pay and insure the returned shipping of the defective product/equipment back to the Seller’s designated warranty location. After the repair or replacement has been done, it is the responsibility of the Seller to return to the Customer/Purchaser and pay for the return shipping and return shipping insurance.
  • If the returned product/equipment does not have any signs of the detailed written defect and is tested out to be working properly without the disclosed written defect, the Customer/ Purchaser will be notified and the product will be returned to the Customer/ Purchaser and the Customer/Purchaser will be responsible for the return shipping and/or handling charges.
  • Any sold Product that has been altered, disassembled, installed incorrectly, damaged due to abuse or vandalism, mishandling, installed without an adequate surge protector, installed not according to local electrical codes, running the equipment constantly during heavy rains or electrical storms, not using the supplied TV cover, running the TV Product continuously 24/7 (unless otherwise stated in an exception and stated in the Seller’s Invoice or written warranty), not abiding by the procedures stated in the Operations/Owners Manual and the Terms and Conditions of the submitted Product Warranty would void any warranty claims.
  • Customer/Purchaser agrees to return the TV Remote Control, TV cover and all of the product accessories that came with the original TV Product, except the TV Mount and Speaker Bar.

PRICE GUARANTEE:
Seller reserves the right to discount and/or run sales on any selected products. Seller shall give the Customer/Purchaser a 10 day Price Guarantee from the time of invoiced payment and further agrees to rebate the Customer/Purchaser the sale price difference of the Product only and not shipping charges and applicable sales tax. Price Guarantee is only on new invoiced products and does not include the sale of Demo, Used and Open Box Sales. Customer/Purchaser is responsible to notify the Seller and submit their original invoice receipt to receive a Price Guarantee Rebate.

PRODUCT PRICING & AVAILABILITY DISCLAIMER:
Seller reserves the right to make adjustments, from time to time, concerning product pricing which includes: Product Offerings, Product Discontinuation, Product Unavailability, Product Donors (name brand TV models that have been custom altered for outdoor use), Product Specifications, Errors and/or Typo Errors in Advertisements and Product Literature. Due to circumstances that could occur and would be beyond the control of the Seller, Seller cannot guarantee that it will be able to meet specified delivery dates, exact shipping dates or fulfill the Customer/Purchaser’s order. If the Seller could not fulfill delivery of the said order, the Seller would reimburse all and any advanced payments received from the Customer Purchaser on the sales transaction that was not fulfilled.

EXPORTING POLICIES:
Our products are sold EXW Las Vegas, Nevada.

The Customer/Purchaser needs to arrange their own export/import and we suggest they do so, by using their own export/import shipping agent. In order to place an order and receive our products the Customer must agree to the terms and conditions stated below, by signing.

Customers must arrange their own freight/shipping, either themselves or through a shipping/freight export/import agent. All freight/shipping, export, duties, customs clearance, charges, export documents and/or any other exporting cost relating to the export purchase transaction will be the responsibility of the Purchasing Customer.

Terms and Conditions of this Transaction:

  • Customer acknowledges and understands that the ordered products have been tested and inspected by the Seller, and the ordered product(s) is operating properly and is undamaged, prior to shipping.
  • Customer also acknowledges and understands that the products have been packaged properly for normal ground truck shipping within the United States and the Customer is responsible for any additional shipping packaging that may be required for export air and/or sea shipping.
  • Once the ordered product leaves our (Seller’s) shipping location and the bill of lading has been issued, Seller is released from any shipping damages and/or loss that may occur during shipping and any claims involving shipping damages, shipping insurance, and/or loss of the shipment shall be the responsibility of the Customer.Warranty, Service, Repairing or Replacing the Product:The exported products will fall under the same terms and conditions of our (Seller’s) standard written warranty. Due to the customization of the Product(s), the defective product must be returned to our (Seller’s) designated service location. It is the Customer’s responsibility to arrange and pay for the return freight and any associated importing fees and/or required documents that would be necessary to ship the defective product back to our (Seller’s) designated service location in Las Vegas, Nevada. All return freight and associated exporting costs, such as duties, taxes, custom clearance charges and etc. shall be the responsibility of the Customer. On a case-by-case basis, we (Seller) can waive the return of the defective product, if the product is determined defective under the terms and conditions of the product warranty and just replace the defective product with a new replacement. We (Seller) shall have the sole discretion in the terms and conditions to return the defective product.

LIMITATION OF LIABILITY:

  • Under no circumstances and notwithstanding the failure of essential purpose of any remedy set forth herewith in, with the Seller, its Affiliates or their Suppliers, Subcontractors, or Agents be liable for any incidental, indirect, punitive or consequential damages, installation charges, including but not limited to, loss of any profits, business revenues or loss of customers, even if the Seller has been advised of the possibilities of such damages, whether a claim for any such liability is premised upon breach of contract, warranty, negligence, strict liability, or any other foreseen liability, any claims, demands or actions against the Customer/Purchaser by any third party for any loss and/or claim arising out of this sales transition.
  • NO IMPLIED WARRANTY INCLUDING THE SELLER’S ABILITY & FITNESS FOR PARTICULAR PURPOSE APPLIES TO THE PRODUCT, AFTER THE APPLICABLE PERIOD OF THE EXPRESSED LIMITED WARRANTY & NO OTHER EXPRESSED OR IMPLIED WARRANTY OR GUARANTY, GIVEN BY ANY OTHER PERSON, FIRM OR CORPORATION WITH RESPECT TO THIS PRODUCT SHALL BIND THE SELLER, OR ANY OF IT’S REPRESENTATIVES SHALL NOT BE RESPONSIBLE FOR ANY LOSS, EXPENSE, SHIPPING COST, RETURN SHIPPING COST, INSTALLATION/LABOR COST, DELIVERY DELAYS, INCONVENIENCES, OR FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY THE PRODUCT FAILURE UNDER THE ABOVE TERMS AND CONDITIONS. THE PRODUCT WARRANTY AND THE TERMS AND CONDITIONS OF THIS SALES TRANSITION SHALL NOT EXTEND TO ANY THIRD PARTY, OTHER THAN THE ORIGINAL CUSTOMER/PURCHASER OF THE PRODUCT, UNLESS FURTHER AUTHORIZATION HAS BEEN GIVEN IN WRITING, BY THE SELLER. NO OTHER MODIFICATIONS, ORAL OR IN WRITING, TO PERTAINING TO THIS SALES TRANSACTION SHALL BE VALID. GOVERNING LAW, INTERPRETATION AND ENFORCEMENT TO THE TERMS AND CONDITIONS PERTAINING TO THIS SALES TRANSITION SHALL BE GOVERNED BY THE LAWS OF THE STATE OF NEVADA, USA.
